Physicians May Be Eligible for Recent Blue Cross Blue Shield (BCBS) Settlement

Blue Cross Blue Shield (BCBS) has agreed to a $2.8 billion settlement to resolve claims of anticompetitive practices impacting physicians and healthcare facilities. The lawsuit claimed that BCBS violated antitrust laws by illegally dividing the United States into service areas and agreeing not to compete in those areas. This practice led to reduced reimbursements and increased costs for providers.
Both BCBS and provider plaintiffs have agreed to a settlement to avoid the risk and cost of further litigation. The settlement fund intends to compensate healthcare providers for the alleged anticompetitive practices and hopes to bring about changes to how BCBS operates.
Those eligible for the settlement fund include “all [not excluded] providers in the U.S. who currently provide or provided healthcare services, equipment or supplies to any patient who was injured by, or was a member of or a beneficiary of, any plan administered by any Settling Individual Blue Plan from July 24, 2008, to October 4, 2024.” A provider means any person or entity that provides healthcare services in the U.S. including physicians, group practices, or facilities. Claims must be submitted by July 29, 2025.
