CMS Releases FAQs on No Surprises Act

August 25, 2022

The Centers for Medicare and Medicaid Services (CMS) has released new FAQs providing guidance on the No Surprises Act, including requirements related to disclosures and the qualified payment amount.

CMS has also rolled out new functionality with its dispute portal that allows initiating parties to upload supporting documents when they begin a dispute. This is being done to prevent delays in dispute processing.

Between April 15 and August 11, more than 46,000 disputes were initiated through the independent dispute resolution (IDR) process. CMS has created a new page on the No Surprises Act website containing some common mistakes and helpful tips for initiating parties to address the unanticipated amount of initiated disputes and the amount of disputes that have been initiated, but are not eligible for the IDR process.
