Bill That Modifies BMP’s Authority Debated in House Committee

March 10, 2022

On March 8, the House Health Finance and Policy Committee passed HF3631 (Rep. Kelly Morrison, MD, -DFL, Deephaven), a bill offering modifications to the state’s medical practice act.

The bill mostly made technical changes related to accepted certification examinations required for licensure. It also included a new authority to assess new fines.

This new disciplinary language gave the BMP authority to issue fines of up to $10,000 “to discourage similar violations.” The bill provided no limits on how or when these fines would be used.

The MMA opposed this new authority and argued that the BMP provided little rationale for the need of this new disciplinary authority. We worked with Morrison who agreed to offer an amendment to remove the language, which was accepted by the committee.  With the amendment adopted, the MMA supported the remainder of the bill.

The bill was laid over for possible inclusion in the House Health omnibus bill.
